All I was saying was that (in the US at least) sending that letter is not a crime.
I agree that it does not fall under that category in his country as they have different laws and enable private citizens to initiate criminal proceedings. In effect what the “private prosecutor” does is initiate a case that will be heard by the court where evidence will be presented. The court then determines if this is a crime. The way it works elsewhere - you go to the police, they ask if you want to “press charges”, you say yes and they make a determination if it does and send it to the public prosecutor.
What Croatia does is take the police out of the equation and the private prosecutor passes on information regarding the crime and the court acts as the prosecutor if it deems a crime has indeed been committed.
Personally I think it’s a system that is vulnerable to abuse which this case is emblematic of.

But this is a tangible amount, i.e. something that can be proven that the plaintiff actually lost in cash value as a direct result of the respondent’s actions. Lloyd is setting an arbitrary amount that he wants in cash in order for HIM to consider this case as settled. There is no proof of these damages and the only way this is ever proven is in discovery where he has to open his books and point to a specific loss and try to blame it on this tweet or that forum post. Good luck with that.
This puts the defendant on notice, if the case goes to court the plaintiff can point out they made a reasonable effort to settle the problem outside the courts.
He’s not doing this in “good faith” nor is it reasonable. I’m sure his lawyers did advise him to send out demand letters in order to demonstrate to the court he was willing to settle. But what his lawyers didn’t account for was the fact that their client is a dipshit who after the fact, posted on social media that this was never a negotiation and he was getting the arbitrary amount HE set or else. This invalidates most if not all of that gesture.
It’s an age-old maxim that you always ask for more than what you’d accept. If this was done in good faith, for example imagine if someone countered with taking the content down and he came back with “take it down and apologise”. Now that’s an actual negotiation done in good faith. Instead he’s saying “no I want the money” which is a bit of a red flag for the court as to his motivation.
I’ve been involved in civil litigation before and the court’s primary concern is coming to a compromise that is fair to both parties.
Add in the fact that most of the alleged defamation is directly culled from his livestream, why should anyone settle with him? I wouldn’t even take the content down, let alone pay him. He’s only trying what he’s always done which is bully people into deleting everything, shutting up and going away.
One telling factor is the low ball statement of damages
He asked for €3000 from Jonathan Burger, Cappytan, Altworldly, JW Beliefs Discussed, and €8000 from the rest. €8000 is hardly a King’s ransom but it’ll definitely be missed and I know for a fact that in more than a few cases it was outright impossible for the “defendant” to pay. His total damages he was asking for was €56,000.
As my algebra teacher always used to say, “show your work”. That’s a shit tonne of money to pay a guy who got drunk on a livestream and admitted to nearly everything Kim said. I still remember thinking “is this real? Does he know he can’t ever take this back?”
€56,000 in damages requires a lot of disclosure that he’s in no way ever going to allow for the simple fact that it would prove how much he’s been fleecing this community. €56,000? That’s more than what most of his patrons earn in a year.
The court exists for justice for all parties, not to act as a bill collector for Jabba the Hutt.

The problem stems from Croatia evidently having a "private prosecutor" procedure. I can't help but think this stems from the Yugoslav Wars era and the aftermath in the late 90s. Countries like Croatia and Bosnia were devastated. There had to have been people guilty of crimes such as destruction of property, looting and false imprisonment. Basically, too small of potatoes to be hauled in front of a tribunal in The Hague. People were angry and wanted a more direct way of getting justice instead of making a complaint to the police and hoping they have the resources to prosecute.
The private prosecutor feature in the Croatian courts seems to be a result of this. Also, since many of the culprits were from Bosnia or Serbia, there was likely an issue of jurisdiction which was covered by the law. What they didn't intend was for this method to be used to prosecute foreigners for what amounts to digital insults on the internet.
That is precisely what Cora Latham is being sued for. She made no videos and did not appear in her husband's two videos. No, she's being sued because of snarky and insulting tweets and retweeting some of what Kim and others tweeted.
Look at Twitter, especially now that Musk has taken over. As you read this, thousands of insulting tweets, some with information which is not accurate are being sent. Imagine the legal chaos if even 25% of those were privately prosecuted over international borders.
The issue of extortion would have to be based on what the law is in Croatia. Since they allow private prosecution, this is not likely extortion. Is it extortion in countries without private prosecution? Probably.
Take Lloyd's statement from 10 June (which is still up):
(2) The warning letters were non-negotiable and purely a part of the pre-trial process. They were not an intimidation strategy. My lawyers informed me there was no legal compulsion to send them but it would weigh in my favor if I gave those defaming me an opportunity to stop and make recompense. None of the defendants who received warning letters heeded them so we can move straight from pre-trial to the trial stage. In other words, there was one acceptable response to the warning letters, i.e. "I/we apologise and will comply with your request." Since no response of that kind was forthcoming, the lawsuit was filed.
He offered a settlement option but did not conduct it in good faith. No counter-offers were acceptable to him. People were either to pay him €3000 or €8000 and take down all content related to him or be sued. All damages were arbitrarily set by him. Countries without private prosecutor laws would definitely count that as extortion had it happened in their countries. This is why the whole lawsuit suing people with absolutely no connection with Croatia is going to be so fruitless. It might be legal in Croatia, but it won't fly in most other countries.
Evans has taunted several of his targets by sarcastically advising them to get a "good" Croatian lawyer. This comment actually has a point. The only way there is a trial is if the accused can be tricked into hiring a Croatian lawyer. This could be taken as tacit acknowledgement that they are indeed liable under Croatian laws and procedures.

Lloyd’s a liar and no one should believe anything he says. Even on his videos attacking WT he’s been known to exaggerate or sensationalise information in order to gain more clicks.
He can afford the $60 Darth Vader toy. He can afford haircuts and toys for his daughters.
Also initiating the lawsuit and complaining about the amount of money he paid the lawyers doesn’t help his claims of poverty.
He’s also going on beach holidays every few months and is making no secret about it.
His problem right now is his money making empire disguised as activism has been exposed, even to his followers. He’ll never be able to crowdfund for anything like he used to for the simple reason that everyone, supporter or detractor, knows quite well he has the money. Most of his Patrons have left, knowing precisely what their money is being used for.

This is according to Lloyd’s own words as his wife hasn’t said ANYTHING. So take this as you will, but again, this is according to him.
He and Dijana separated in late March and he moved to Zagreb in early April. Here is his comment from Kim’s video about him hitting up a London dating event:
He’s been posting in the Zagreb Expats FB group since early April. He’s also created a new Instagram account to hit on Instagram models either based in Zagreb or will be appearing there. His flat and his studio are located there. It’s probably a safe assumption that his wife and girls are still living with her parents in a flat above their home in Sisak.
As for the pics with his wife and girls on the Croatian beach, those were taken in September round his birthday.
I must opine that whilst it’s strange for a wife who was publicly outted as not sexually compatible after a humiliating Thai hooker scandal to allow herself and her children to be used as a PR prop on social media afterwards, it’s probably safe to say that the relationship between Lloyd and Dijana Evans is no conventional one.

Why are people all round the world, of different backgrounds all falling for what he terms as “Kim’s lies”? At what point does he turn inward and reflect upon it? It seems the more people reject him the more adamant he gets about fighting back.
